Terms of Service

1. Acceptance of Terms
By accessing or using the Time4 platform ("Service") at www.getbookly.com.au, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and Time4 ("we", "us", "our"). These Terms are governed by the laws of New South Wales, Australia.
2. Description of Service
Time4 is a cloud-based scheduling, booking, and business management platform designed for Australian service businesses. The Service includes online booking pages, calendar management, client management, payment processing integrations, automated reminders, and reporting tools.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. Account Registration
Access to Time4 requires a subscription plan. Accounts are set up by our team after a plan is agreed upon. You are responsible for:
- Providing accurate and complete information during onboarding
- Maintaining the security and confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access to your account at support@getbookly.com.au
4. Subscription Plans & Payment
4.1 Plans
Time4 offers monthly subscription plans (Build, Elevate, Innovate) billed in Australian Dollars (AUD) including GST. Plan details and pricing are available at www.getbookly.com.au/#pricing.
4.2 Billing
Subscriptions are billed monthly in advance. Fees are non-refundable except as required by the Australian Consumer Law (ACL). We reserve the right to change pricing with 30 days written notice.
4.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. There are no lock-in contracts or early termination fees.
4.4 Suspension for non-payment
We reserve the right to suspend or terminate your account if payment is not received within 14 days of the due date, after reasonable notice has been provided.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including Australian privacy laws
- Upload or transmit any harmful, offensive, or unlawful content
- Attempt to gain unauthorised access to any part of the Service or other accounts
- Interfere with or disrupt the integrity or performance of the Service
- Collect or harvest personal data from other users without their consent
- Reproduce, resell, or sublicense the Service without our written consent
- Use automated tools (bots, scrapers) to access or extract data from the Service
We reserve the right to terminate accounts that violate these terms without notice or refund.
6. Your Data
You retain full ownership of all client data, business data, and content you upload to Time4. By using the Service, you grant us a limited licence to store, process, and display your data solely for the purpose of providing the Service to you.
We will not sell, rent, or share your data with third parties except as described in our Privacy Policy. Upon account termination, you may request an export of your data within 30 days.
7. Intellectual Property
All intellectual property rights in the Time4 platform, including its design, software, trademarks, and content, are owned by or licensed to Time4. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the Service.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Time4 will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of revenue, data, or business opportunities.
Our total liability to you for any claim arising from these Terms or your use of the Service will not exceed the amount you paid us in the 3 months preceding the claim.
Nothing in these Terms limits our liability for fraud, death, personal injury, or any liability that cannot be excluded under the Australian Consumer Law.
9. Warranties & Disclaimers
The Service is provided "as is" and "as available". We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or meet your specific requirements.
We will use commercially reasonable efforts to maintain 99% uptime but do not guarantee availability. Planned maintenance will be communicated in advance where possible.
10. Third-Party Services
The Service integrates with third-party providers (e.g. payment gateways, SMS providers, email delivery services). Your use of those integrations is subject to their respective terms and privacy policies. We are not responsible for the actions or availability of third-party services.
11. Termination
Either party may terminate these Terms at any time. Upon termination:
- Your access to the Service will cease at the end of the billing period
- We will retain your data for 30 days after termination, after which it may be permanently deleted
- Provisions of these Terms that by their nature should survive termination will remain in effect
12. Governing Law & Disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by email or by posting a notice in the platform. Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
